Terms and Conditions

These Terms of Use (“Terms”) govern your access to and use of the Humalyst BMI Calculator mobile application and related services (the “App”), operated by [Legal entity name] (“we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who we are

2. What the App does

The App provides wellness and lifestyle tools, which may include:

  • BMI and related body-metric calculators and trackers

  • Hydration, mood, and calorie logging

  • Reminders and notifications (if you enable them)

  • Optional account sign-in (Google and/or Sign in with Apple)

  • Optional Humalyst Pro subscription features, including AI Meal Scanner

  • Advertising for non‑Pro users

3. Not medical advice

The App is for informational and personal wellness use only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

BMI, calorie estimates, AI meal analysis, and similar outputs are approximate and may be inaccurate. Always consult a qualified healthcare professional for health decisions. Do not disregard professional medical advice because of something in the App.

4. Eligibility

You must be able to form a binding contract under applicable law. If you are under the age required in your country to use the App or to consent to data processing / in‑app purchases, you may only use the App with a parent or guardian’s involvement as required by law.

5. Accounts

Some features (including Pro entitlements and AI Meal Scanner) may require signing in.

  • You are responsible for activity under your account.

  • Keep your sign-in credentials secure.

  • Pro access is tied to your signed-in account on our servers; signing out or using a different account may change what features you see.

6. Humalyst Pro subscriptions

6.1 Plans

We may offer auto-renewable subscriptions such as weekly, monthly, and yearly plans (names and prices shown in the App and on Apple App Store / Google Play).

6.2 Billing

  • Payment is charged to your Apple ID or Google Play account when you confirm purchase.

  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period (or as required by the store’s rules).

  • Your account will be charged for renewal within 24 hours prior to the end of the current period.

  • Manage or cancel subscriptions in your store account settings:

6.3 Restore

If you reinstall the App or switch devices, use Restore (and sign in with the same account) so we can verify your purchase. Purchases are verified with Apple/Google and bound to your Humalyst account according to our entitlement rules.

6.4 Refunds

Refunds are handled by Apple or Google under their policies, not directly by us (unless required by law).

7. AI Meal Scanner

If you use AI Meal Scanner:

  • You may take or select a meal photo to estimate calories and macros.

  • Photos and related data are processed by our backend services and third-party providers (for example, AI / nutrition data services) solely to provide the feature.

  • Results are estimates only, not laboratory or clinical measurements.

  • Do not upload images you are not allowed to share, or content that is illegal, harmful, or unrelated to meal scanning.

  • We may enforce usage limits (for example, daily scan quotas).

8. Ads

Free users may see third-party ads (including Google AdMob). Pro may remove ads. Ad networks may collect device/advertising identifiers subject to their policies and your device settings.

9. Acceptable use

You agree not to:

  • Misuse the App, attempt unauthorized access, or disrupt our services

  • Reverse engineer or copy the App except as allowed by law

  • Use the App for unlawful purposes

  • Abuse AI features, automation, or quotas

  • Upload unlawful, infringing, or abusive content

We may suspend or terminate access for violations of these Terms.

10. Intellectual property

The App, branding (including “Humalyst”), design, and content are owned by us or our licensors. These Terms do not transfer ownership to you. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

11. Third-party services

The App relies on third parties such as Apple, Google (Play, Sign-In, AdMob), Firebase, and AI/nutrition providers. Their terms and privacy policies also apply when you use those services.

By using the App, you also acknowledge that policy.

13. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES (INCLUDING BMI OR MEAL NUTRITION) WILL BE ACCURATE OR ERROR-FREE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES ARISING FROM YOUR USE OF THE APP.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

15. Changes

We may update the App and these Terms. The “Last updated” date will change when we do. Continued use after changes means you accept the updated Terms. Material changes may be communicated in the App or on our website when appropriate.

16. Termination

You may stop using the App at any time. We may suspend or stop providing the App or features (including Pro features) where needed for legal, security, or operational reasons.
